Terms & Conditions
These Terms and Conditions, together with any Membership Form, Screening Tool, additional Waiver and/or direct debit Service Agreement set out the agreement (this Agreement) under the terms of which you or, where applicable, the person for whom you are the parent or guardian, (your, you, your) will obtain services, including the Activities, from the You Project (You Project, we, us, our).
By becoming a member (“Member”), attending a class, or physically entering any of The You Project's studios, you indicate that you have read, understood, and agree to be bound by the following terms and conditions ("Terms"). If you do not agree with these Terms, you must discontinue use of our studio and services immediately. These Terms and Conditions will apply to all your dealings with You Project, including being incorporated in all agreements or quotations under which You Project is to provide services or Activities to you. The You Project reserves the right to review and amend any of these Terms at its discretion by updating this page. We will make reasonable efforts to notify you of any updates. Your ordering of the Activities or using the studios following such an update will represent an agreement by you to be bound by the Terms and Conditions as amended.

Please familiarise yourself with these Terms and check for updates regularly. Any changes take effect immediately upon publication and apply to all users, unless otherwise stated.

1 DISCLAIMER
1.1 You Project runs yoga, Pilates and reformer classes and may offer other exercise related programs from time to time (the Activities”).
1.2 ​ Participating in the Activities is potentially dangerous and may expose you to risks, including accidents, serious injury, illness or even death. The You Project uses its best endeavours to protect you but there remains a possibility of an accident causing injury, illness, disability, death or property damage.

2 YOU PROJECT RIGHTS
2.1 We reserve the right to restrict your access to our studio(s) and terminate your Membership under circumstances including, but not limited to: (1) violation of these Terms or failure to comply with membership or studio policies, (2) conduct detrimental to the best interests of The You Project or its members, (3) failure to make timely payments, (4) interruption or discontinuation of payments or m membership fees without acceptable resolution.
2.2 If The You Project terminates your Membership, you remain liable for membership fees for the duration of your membership and any fees for services already provided. Within 14 days, we will refund the portion of fees paid that corresponds to unused classes under your membership.
2.3 ​While The You Project aims to deliver classes and services as scheduled, there may be occasions when scheduled classes cannot be held. We reserve the right to modify class schedules, studio hours, membership pricing, and instructors without prior notice and at our absolute discretion.
The You Project reserves the right to replace or discontinue class equipment at any time. Studios may be closed for up to 10 days annually for maintenance.
2.4 We do not offer refunds, transfers, or compensation of any kind for late, changed, or cancelled classes, or inability to attend due to class fullness.
2.5 You are responsible for your possessions while at the Studio/s. You Project will not be liable if any of your possessions are lost and/or stolen at the Studio/s.
2.6 Lockers are provided for storing valuables, but The You Project is not liable for their safekeeping. You use such storage facilities at your own risk.
2.7 Interference with, theft, or damage to others' belongings may result in Membership cancellation and permanent ban from our facilities.

3 CAPACITY AND Age Limits:
3.1 Minimum age to attend classes is 15 years. Clients under 18 years must attend or have consent from a parent or guardian.
3.2 You warrant you:
(a) have the legal capacity and are of sufficient age to enter into a binding contract with us; and/or;
(b) are the parent or guardian of your who consents to this Agreement on behalf of a relevant minor.
4 PRE-ACTIVITY OBLIGATIONS
4.1 You warrant that, on or prior to the Commencement Date, you:
(a) will complete the Screening Tool located in Appendix A and;
(b) if you answer ‘yes’ to any of the questions contained in the Screening Tool, obtain a doctor’s certificate stating that you are allowed to participate in the Activities; or
(c) if you answer ‘yes’ to any of the questions contained in the Screening Tool and cannot or will not obtain a doctor’s certificate stating that you are allowed to participate in the Activities, agree that you participate in the Activities at your own risk, if permitted to do so by the You Project
4.2 have read and agree to the Waiver located in Appendix C; and
4.3 have read and agree to the Rules located in Appendix B

5 YOUR OBLIGATIONS
5.1 You must provide You Project with all documentation, information and assistance reasonably required for You Project to provide the Activities;
5.2 If you are a parent or guardian to a participant under the age of 18, you must ensure that they comply with these terms, and agree to the terms of this Agreement in respect of them.
5.3 INSTRUCTIONS AND SAFETY
You warrant that you will:
(a) comply with any safety guidelines, instructions and/or rules that You Project’s Personnel provide to you;
(b) stop participating in any Activities, and alert You Project or its Personnel, if you have any concerns about your health or safety or if start feeling dizzy, faint, unwell or feel any unusual pain during the Activities; and
(c) be responsible for your own safety and that of any person under the age of 18 years for whom you have signed responsibility.
6 HEALTH AND STATE OF THE PARTICIPANT
6.1 You warrant that you:
(a) Subject to clause 7, do not have a health condition which might have the effect of making it more likely that you will be involved in an accident or injury while participating in the Activities (Condition);
(b) will notify You Project immediately if you develop a condition;
(c) are aware and agree that if they have a condition, You Project might refuse you participation in some and/or all Activities;
(d) are aware that the Activities, even when no accident occurs, may involve risk to health;
(e) will not participate in the Activities under the influence of drugs, alcohol or illicit substances;
(f) will not participate in the Activities, if ill, injured or feeling unwell; and
(g) will warm-up prior to participating in the Activities.
7 PREGNANCY POLICY
At You Project, we prioritise the safety and well-being of all our clients, especially expectant mothers. We strive to provide a supportive environment for fitness and wellness, tailored to individual needs.
Please review the following guidelines regarding pregnancy and participation in our classes:
7.1 Communication with Instructor: It is essential to inform the instructor if you are pregnant before participating in any class at You Project. This enables us to provide necessary modifications and ensure your safety and comfort during the session.
7.2 Consultation with Healthcare Provider: You Project advises all expectant mothers to consult with their doctor or obstetrician to determine the most suitable fitness regimen during pregnancy. We recommend obtaining a letter of clearance from a healthcare provider before commencing any classes at You Project.
7.3 If you are pregnant, you agree and acknowledge the following:
(a) Studio Environment:
Please note that our mat room is heated to approximately 30 degrees Celsius. Ensure your healthcare provider is informed about this environment.
(b) Further Guidance:
For guidance on suitable prenatal fitness options, please contact our studio directly. We are committed to supporting you in maintaining a healthy and active lifestyle throughout your pregnancy journey.
(c) Acknowledgment of Risks and Medical Condition
(d) By participating in classes at You Project, you acknowledge that you have read and understood the pregnancy policy outlined above and agree to adhere to its guidelines for your safety and well-being.
8 PURCHASES
8.1 All purchases are final; refunds are not provided for services or products due to change of mind, injury, illness, change of address, or any other reason.
8.2 All passes and memberships are non-transferable and may not be shared.
9 CANCELLATION POLICY
9.1 Cancellation Policy for You Project Studio: Effective July 1st, 2024, our cancellation policy is designed to ensure the smooth operation of our studio and to provide ample notice for others to enrol in classes.
9.2 If you cancel classes:
(a) Early Cancel ($0): If you cancel your booking at least 12 hours before the class start time, this is considered an early cancel, and no fees will apply.
(b) Late Cancel ($10): Canceling your booking within 12 hours of the class start time is deemed a 'Late Cancel'. For members, a one-time cancellation fee of $5 will be charged. For clients attending Casual Classes or using a Class Pass pack, the class will be forfeited from your account.
(c) No-show ($15): Failure to cancel your class before the start time and not attending will be considered a 'No-show'. Members will incur a one-time cancellation fee of $10, and for Casual Class attendees or Class Pass holders, the class will be forfeited from your account.
9.3 Class Cancellation Process:
Class cancellations are the responsibility of the participant and must be carried out through the You Project Studio app or website. Please note that cancellations will not be accepted via phone, text, or social messaging.

9.4 Payment: You acknowledge and agree that cancellation fees will be charged to your nominated credit card or bank account.
9.5 By Us: You Project may terminate this Agreement in whole or in part immediately by written notice to you if your is in breach of any term of this Agreement.
9.6. Membership and upfront payment Cancellation: if you cancel your membership or upfront payment you will not be eligible for a refund and must pay the for the minimum term.

10 WAITLIST POLICY
Joining the Waitlist: If a class is fully booked, you can opt to join the waitlist. You will be notified via email or text (based on your subscription opt-in) if a spot becomes available, and you will be automatically added to the class.
10.1 Confirmation: When registering for the waitlist, please assume that you will be added to the class if a spot opens up. Be sure to check your email or text for your class confirmation if you're on the waitlist.
10.2 Cancellation: If you change your mind or find that you cannot attend the class you're waitlisted on, please remove yourself from the waitlist online or via the You Project Studio app with as much notice as possible.
10.3 Cancellation Policy: Once you have been automatically confirmed in the class from the waitlist, our standard cancellation policy applies. Please refer to the cancellation policy outlined above for details.
10.4 Waitlist Blocking: Waitlists are blocked 2 hours before the class starts. During this timeframe, you will not be automatically added from the waitlist. If you notice availability to sign up directly within 2 hours of the class start time, it indicates that there are open spots, and you should book yourself in directly.
11 MEMBERSHIP AND COOLING OFF
11.1 The types of membership or class pass terms are set out at Appendix D.
11.2 You are able to cancel a membership agreement without incurring any cancellation Fees, if you notify us of your intent to cancel in writing within 7 days of signing this Agreement (Cooling Off Period). Pro rata fees for any services used in the 7 days will apply.
12 PAYMENT
12.1 Your must pay the Fees to You Project, in the amounts and at the times set out in any confirmation of membership or as otherwise agreed in writing.
12.2 We accept payment via credit cards, direct debit, or cash for purchases of memberships, class passes, and other services.
12.3 Billing cycles for memberships and class passes vary depending on the type of membership purchased. Late payments may result in penalties or suspension of membership privileges. Please refer to specific membership terms for details.
12.4 You will sign any applicable direct debit service agreement if your membership plan requires direct debit and failure to do so will result in cancellation of your membership.
12.5 If You Project issues an invoice to you, payment must be made by the time(s) specified in such invoice.

13 WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012
13.1 Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form is required to ensure that the recreational services it supplies to you:
(a) are rendered with due care and skill; and
(b) are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier; and
(c) might reasonably be expected to achieve any result you have made known to the supplier.
13.2 Under section 22 of the Australian Consumer Law and Fair Trading Act 2012, the supplier is entitled to ask you to agree that these statutory guarantees do not apply to you. If you agree to these terms you will be agreeing that your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 if you are killed or injured because the services provided were not in accordance with these guarantees, are excluded, restricted or modified in the way set out in this form.
13.3 NOTE: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier’s part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.

14 LIABILITY AND INDEMNITY
14.1 By participating in classes at You Project, you acknowledge the inherent risks associated with physical exercise and understand that it is your responsibility to consult with a physician regarding my medical fitness to participate in these activities. You release You Project and its instructors from any liability for injuries that may occur during classes or while using studio facilities.

14.2 To the maximum extent permitted under applicable law, and without limiting any of your rights under the Competition and Consumer Act 2010 (Cth) You Project’s liability for all claims in aggregate (whether those claims be for breach of contract, negligence or otherwise, and whether those claims are for economic loss, or for personal injury or other damage) arising under or in connection with this Agreement:
(a) is excluded, to the extent it concerns liability for indirect, special and consequential damages, and damages (whether direct or indirect) reflecting loss of revenue, loss of profits or loss of goodwill; and
(b) is limited, insofar as it concerns other liability, to the total money paid to You Project under this Agreement as at the date the event giving rise to the relevant liability occurred (or, where there are multiple events, the date of the first such event).
14.3 You acknowledges that while You Project uses its best endeavours to ensure that the Studio/s and any facilities and/or equipment are free of faults and safety issues, there may be instances of equipment failure, and/or equipment and other objects may be left in incorrect positions by other Studio/s users. You agrees that You Project will not be liable for any loss or damage arising out of such circumstances unless there is reckless disregard or gross negligence on You Project’s behalf.
14.4 Your will bear all risk of loss or destruction of, or damage to, any equipment and/or other property and/or people arising out or contributed to by their participation in the Activities.
14.5 You indemnify You Project from and against all losses, claims, expenses, damages and liabilities (including any taxes, fees or costs) which arise out of:
(a) any breach of this Agreement by you;
(b) any negligent, fraudulent or criminal act or omission by you; or
(c) an event, where circumstances giving rise to a claim, were caused or contributed to by you,

15 WARRANTIES
15.1 To the maximum extent permitted by applicable law, all express or implied representations and warranties (whether relating to fitness for purpose or performance, or otherwise) not expressly stated in this Agreement are excluded.
15.2 Nothing in this agreement is intended to limit the operation of the Australian Consumer Law contained in the Competition and Consumer Act 2010 (Cth) (ACL). Under the ACL, you may be entitled to certain remedies (like a refund, replacement or repair) if there is a failure with the goods or services provided.
16 CODE OF CONDUCT
16.1 Participants are expected to conduct themselves respectfully towards instructors and fellow participants. Studio etiquette includes arriving on time for classes, refraining from disruptive behavior, and following instructor guidance. Failure to comply may result in suspension of studio privileges.
17 INTELLECTUAL PROPERTY RIGHTS
17.1 All intellectual property rights associated with You Project, including trademarks, logos, and class content, belong solely to You Project. Participants agree not to reproduce, distribute, or use any intellectual property without prior written consent from You Project.
18 PRIVACY POLICY
18.1 You Project respects your privacy and is committed to protecting the personal information you provide. We collect, use, and store personal information in accordance with applicable data protection laws. For details, please refer to our Privacy Policy available on our website or upon request.
18.2 You agree to be bound by our Privacy Policy.
18.3 You consent to us taking images and recording video footage of you for the following purposes only:
(a) promotion of the Gym, Gym events and advertising the associated products and services; and
(b) publication on social media platforms or in newspapers, in trade and other journals and on websites and the internet for the purposes of professional advancement,
(c) in accordance with our Privacy Policy

19 STUDIO POLICIES
19.1 Additional studio policies may include dress codes, parking regulations, and equipment usage rules. Participants are expected to adhere to these policies to ensure a safe and enjoyable experience for all.
20 GIFT CARD TERMS AND CONDITIONS
20.1 Gift cards are subject to these terms and conditions.
20.2 Gift cards are not redeemable for cash.
20.3 Validity and Expiry:
(a) This gift card is valid for 3 years from the date of purchase.
(b) The expiry date will be clearly stated on the gift card or in the acYou Projecting documentation.
20.4 Redemption:
(a) Gift cards can be redeemed for any products or services offered by You Project.
(b) Gift cards are not redeemable for cash or refundable.
20.5 Fees:
(a) No additional fees will be applied to the gift card after purchase.
(b) The full value of the gift card can be used without deductions.

20.6 Lost or Stolen Cards:
(a) You Project is not responsible for lost or stolen gift cards.
(b) Replacement of lost or stolen gift cards is not guaranteed and is subject to You Project’s discretion.
20.7 Usage:
(a) The gift card must be presented at the time of redemption.
(b) Any unused balance will remain on the card and can be used for future purchases until the card expires.

21 GENERAL
21.1 GENERAL

21.2 This agreement is governed by the law applying in Victoria. Each party irrevocably submits to the exclusive jurisdiction of the courts of Victoria and courts of appeal from them in respect of any proceedings arising out of or in connection with this agreement. Each party irrevocably waives any objection to the venue of any legal process on the basis that the process has been brought in an inconvenient forum.
21.3 This agreement may only be amended in accordance with a written agreement between the parties.
21.4 No party to this agreement may rely on the words or conduct of any other party as a waiver of any right unless the waiver is in writing and signed by the party granting the waiver.
21.5 Any term of this agreement which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity and enforceability of the remainder of this agreement is not limited or otherwise affected.
21.6 An obligation or a liability assumed by, or a right conferred on, two or more persons binds or benefits them jointly and severally.
21.7 A party cannot assign, novate or otherwise transfer any of its rights or obligations under this agreement without the prior written consent of the other party.
21.8 This agreement may be executed in any number of counterparts. Each counterpart constitutes an original of this agreement and all together constitute one agreement.
21.9 Except as otherwise provided in this agreement, each party must pay its own costs and expenses in connection with negotiating, preparing, executing and performing this agreement.
21.10 This agreement embodies the entire agreement between the parties and supersedes any prior negotiation, conduct, arrangement, understanding or agreement, express or implied, in relation to the subject matter of this agreement.

21.1 INTERPRETATION
(a) (singular and plural) words in the singular includes the plural (and vice versa);
(b) (gender) words indicating a gender includes the corresponding words of any other gender;
(c) (defined terms) if a word or phrase is given a defined meaning, any other part of speech or grammatical form of that word or phrase has a corresponding meaning;
(d) (person) a reference to “person” or “you” includes an individual, the estate of an individual, a corporation, an authority, an association, consortium or joint venture (whether incorporated or unincorporated), a partnership, a trust and any other entity;
(e) (party) a reference to a party includes that party’s executors, administrators, successors and permitted assigns, including persons taking by way of novation and, in the case of a trustee, includes any substituted or additional trustee;
(f) (this agreement) a reference to a party, clause, paragraph, schedule, exhibit, attachment or annexure is a reference to a party, clause, paragraph, schedule, exhibit, attachment or annexure to or of this agreement, and a reference to this agreement includes all schedules, exhibits, attachments and annexures to it;
(g) (document) a reference to a document (including this agreement) is to that document as varied, novated, ratified or replaced from time to time;
(h) (headings) headings and words in bold type are for convenience only and do not affect interpretation;
(i) (includes) the word “includes” and similar words in any form is not a word of limitation;
(j) (adverse interpretation) no provision of this agreement will be interpreted adversely to a party because that party was responsible for the preparation of this agreement or that provision; and
(k) (currency) a reference to $, or “dollar”, is to Australian currency, unless otherwise agreed in writing.

Appendix A – SCREENING TOOL
The Screening Tool below is intended for general use only and in no way guarantees against harm to health injury or death. You Project accepts no liability for any loss, damage or injury that may arise from any person acting on any information contained in this tool.
Appendix B – Studio Rules
(a) Participants must arrive 5-10 minutes before scheduled class times; late entry is not permitted.
(b) No animals are allowed inside The You Project studios; you may be asked to leave if accompanied by an animal.

(c) Timeliness: Classes start and end promptly. We recommend arriving at the studio at least 10 minutes before the scheduled start time to prepare for a hassle-free experience and to avoid being locked out. Please note that studio doors are locked during classes, and late entry is not permitted.

Appendix C– AGREEMENT AND WAIVER
YOU PROJECT WAIVER
1. You understand and acknowledge that the Activities, including but not limited to access to Studio/s and equipment as well as training, programs, and events held by You Project may expose you to risk, including accidents, injury, illness or even death. You assume all risk of injuries associated with participation in the Activities, including but not limited to, falls, contact with other participants, equipment failure, risks inherent in martial arts activities, such as impact injuries, physical risks inherent in exercise, the effects of the weather, including high heat and/or humidity and the loss of your personal property and exclude You Project from liability.
2. Because physical exercise can be strenuous and subject you to risk of serious injury, You Project urges you to obtain a physical examination from a doctor before using any exercise equipment or participating in any Activities. You agree that when you use the Studio/s, engage in the Activities, on the premises or off the premises, including at an event, you do so entirely at your own risk.
3. You warrant and represent that you have no injuries, physical restrictions, disabilities or predispositions to sickness or injury (Conditions) that may affect your participation in the Activities or that if you are aware of such Conditions, you participate in any activities provided by You Project entirely at your own risk.
4. You exclude You Project and its officers, employees and contractors, the organisers, sponsors, other participants and any other persons involved in your participation in the Activities with You Project (Releasees) from any demand, claim, or other proceeding in relation to any injury or death or loss or damage to personal property in connection with your participation in the Activities with You Project, whether or not caused by the negligence of a Releasee.
5. You agree to indemnify each Releasee in relation to any demand, claim or proceeding that may be brought in connection with your participation in the Activities with You Project where circumstances giving rise to such a demand, claim, or proceeding were caused or contributed to by you or your breach of You Project Membership Form and Agreement.
6. You agree that should any part of this Agreement and waiver be found by a court of law to be against public policy or in violation of any state statute or case precedence, then only that wording is removed and the remainder of this Agreement and waiver will remain in full force.

Membership or Class Pass Terms
Weekly Memberships:

Membership fees are debited weekly, including processing fees.

Minimum term is 8 weeks with no cancellations or suspensions allowed during this period.

Cancellations must be made via email to info@youprojectco.com.au and require 14 days' notice.

Memberships are non-transferable.

You can suspend your membership for up to 8 weeks per calendar year, with a minimum suspension period of 2 weeks.
Foundation Yearly Memberships:

The Yearly Mat Membership grants unlimited access to yoga, hot mat Pilates for 12 months.

The Yearly Full Studio Membership offers unlimited access to yoga, hot mat Pilates, and 2 classes per week of reformer Pilates for 12 months.

Upfront payment is required for yearly memberships.

Minimum term is 12 months with no refunds or extensions.

Yearly pricing option includes a significant discount and does not accommodate suspension periods.

Memberships are non-transferable.
Class passes:
5, 10 and 20 class passes are available, with one upfront payment.

You Project does not offer refunds, transfers, suspensions or extensions on any class passes

In the event you booked into a class and do not show, the class will be forfeited and deducted from your account

Prices may increase from time to time to reflect increases in costs and benefits
Introductory Offer
The 14 Day Introductory is a once only offer and gives you 14 consecutive days of unlimited classes at You Project. The 14 days starts from your first class booking, once this is made it cannot be changed.
